Terms of services
1. Existence of a Contract
This contract between you and the E-ACCIDENT OÜ governs your use of the E-Accident services (the “Service”).
Service is only available to persons 18 years of age and or older at the time of the acceptance of these Terms of Service. If you are between the ages of 16 and 17, you must have your parent or the holder of parental responsibility permission to use the Service and to agree to these Terms.
By installing, using or otherwise accessing the Service, you agree to these Terms of service. If you do not agree to these Terms of Service, please do not install, use or otherwise access the service.
E-ACCIDENT OÜ reserves the right, at its discretion, to change or modify these Terms of Service at any time by posting the amended Terms on Service. You will be deemed to have accepted such changes by continuing to use the Service. If at any point you do not agree to any part of the current version of Terms of Service, our Contract shall immediately terminate, and you must immediately stop using the Service.
2. Description of E-Accident
E-Accident allows you together with other stakeholders to fulfil a form of European Accident Statement about happened traffic accident and to transmit it to insurance companies via the internet.
The use of E-Accident is free of charge, except indirect costs, such like price of your internet connection needed to use E-Accident’s systems which will be charged by your service provider.
3. Obligations of the parties
Obligations of E-ACCIDENT OÜ:
E-ACCIDENT OÜ provides the Service promptly and according to the state of the art solutions and techniques.
E-ACCIDENT OÜ undertakes, without cost to the user, to implement all the means and actions necessary to ensure that the application works normally and continuously.
Obligations of the user:
- In order to use the Service, you will need to input personal information, such as:
- Your personal information;
- The information available on the green card of your vehicle (including policy number);
- The information available on your driver’s license;
- You agree to provide accurate and complete information as well as update them when needed.
- You agree to input as many times as it will be required by the Service your personal data and data relating to the accident correctly, fairly and promptly you want to declare to your insurance company.
- You agree to use the Service according to the instructions and user guides available on www.e-accident.eu and in accordance with this contract.
- You are solely responsible for the confidentiality, security and use of the Service. E-ACCIDENT OÜ cannot be held responsible for any unauthorised use of your account.
- You agree not to access the Service by any means other than via the application you can download on the Appstore and Google Play.
- You agree not to circumvent, modify or alter the security dispositions of E-Accident as well as not to help any other person to do so.
- You agree not to declare an accident statement via the Service if the accident has not actually happened.
- You agree that the input of data in E-Accident can be used as evidence in court for as well as against you.
- You agree to remake an accident statement on a paper form if your insurance company requires it, correctly, fairly, promptly and in exact accordance with the accident you had previously completed via the E-Accident app.
4. Suspension and Termination of Account and Service
Without limiting any other remedies, E-ACCIDENT OÜ may limit, suspend, terminate, modify, or delete accounts or access to the Service thereof if you are, or E-ACCIDENT OÜ suspects that you are, failing to comply with any of these Terms of Service or for any actual or suspected illegal or improper use of the Service, with or without notice to you.
5. Copyrights – Intellectual property
All copyrights relating to E-Accident and its components are the sole property of the E-ACCIDENT OÜ.
You agree that the software, its operation, its content, including display logos and graphics, links to other internet resources are protected by the laws on intellectual property and in particular copyright.
You also agree not to reproduce, modify, rent, give, lend, sell, distribute or create the elements listed above in any manner and in any form whatsoever.
6. Disclaimer of Warranties
E-ACCIDENT OÜ tries to keep the Service up, bug-free, and safe, but you use it at your own risk. E-ACCIDENT OÜ are providing the Service as is without any express or implied warranties including, but not limited to, implied warranties of fitness for a particular purpose and non-infringement.
E-ACCIDENT OÜ does not warrant:
that you will be able to access or use the Service at the times or locations of your choosing;
that the Service will be uninterrupted or error-free;
that defects will be corrected;
or that the Service are free of harmful components.
You agree that the Service may be interrupted for non-predefined periods for reasons of technical operations.
E-ACCIDENT OÜ will attempt as far as possible and as quickly as possible to remedy any malfunction or error by updates to the application.
E-ACCIDENT OÜ disclaims any liability for damages arising from the use of E-Accident such as damages to the device on which the application is installed and the data contained.
E-ACCIDENT OÜ assumes no responsibility for loss of time and loss of income incurred due to software malfunction, loss of data, delays and transmission operation and the necessity of having to write an accident statement in paper form.
E-ACCIDENT OÜ shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of E-ACCIDENT OÜ , including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond E-ACCIDENT OÜ’s control. E-ACCIDENT OÜ assumes no responsibility for the harmful consequences, which may arise from attack, viruses, hacking or any other breach of security that might result from it.
You acknowledge and entrust E-ACCIDENT OÜ with an expressly given consent to use the data you have entered in E-Accident in order to enable:
the creation of a European Accident Statement according to the data you have entered;
the use of the data for statistics and/or marketing (if you previously agreed), while ensuring the confidentiality and respect of your anonymity.
E-ACCIDENT OÜ respects your privacy and makes every effort to respect your rights in this regard in the context of using the Service.
To enable you to use the service provided by E-Accident, we will have some of your personal data. We will clearly indicate the type of information necessary to provide the requested service.
E-ACCIDENT OÜ collects information from or about devices where you install or access the Service, log information, cookies and similar technologies to identify your browser or device. E-ACCIDENT OÜ may associate the information that collects from your device for purposes such as improving the quality of the Service, or for statistics purposes.
Your personal data will be passed along to third party just with your confirmatory action by fulfilling European Accident Statement and transmitting data to insurance company and to other stakeholders involved in the traffic accident.
E-ACCIDENT OÜ is responsible for handling personal information collected through the application and may delegate to a subcontractor.
E-ACCIDENT OÜ will retain your information for as long as your account is active or as needed to provide the Service or as needed to comply your or E-ACCIDENT OÜ legitimate rights and interests.
Whenever you use the Service, E-ACCIDENT OÜ aims to provide you with the access to your personal information. If your personal information changes, you can correct, update, or delete inaccuracies by making the change within your account settings or by contacting us at [e-mail address].
You can object to data processing for direct marketing purposes at any time by changing the options within your account settings or by contacting us at [e-mail address].
You can restrict your personal data processing by contacting us at [e-mail address], if you asked E-ACCIDENT OÜ no longer to process them, except for storing, and they are needed by you for the establishment, exercise or defence of legal claim.
If you wish receive a data copy of your personal data in machine-readable format for your own purposes or for transmitting it to another company, contact us at [e-mail address].
If you wish to delete your account with all your personal data and/or request that E-ACCIDENT OÜ no longer use your information to provide you the Service, contact us at email@example.com.
Of noncompliance with data processing you have the right to lodge a complaint with a data protection authority.
8. Dispute Resolution and Law
If a dispute arises between you and E-ACCIDENT OÜ, we strongly encourage you to first contact us directly to seek a resolution by going to our customer support site at www.e-accident.eu or by contacting us at firstname.lastname@example.org.
The laws of Estonia will govern these Terms and any dispute that arises between you and E-ACCIDENT OÜ. All disputes related to these Terms or the Service will be brought solely in the court of Tallinn, Estonia.
